 1. General Conditions of Sale

1.1. These terms apply to all sales of paintings, posters, gift vouchers and other items offered for purchase exclusively via the website golden-ratio.nl.

1.2. The conditions are available on the website at the time you place an order, and you must accept them before your purchase can be confirmed.

1.3. Many of the artworks presented on the website are by artists from the early and mid-20th century. As such, they may show age-related characteristics. Before buying, you should carefully review the images provided and, where necessary, request a condition report to assess the current state of the work.

Customer Service can be reached from Wednesday to Sunday (excluding public holidays) during the gallery’s opening hours, primarily by email. Current contact details can be found on the “Galleries” page of our website.

3. Prices and Paintings

3.1. All prices shown on the website are in Euro (€) and include applicable taxes, unless stated otherwise. Packing, insurance and delivery charges are not included in the listed price and will be specified separately where relevant.

3.2. The price invoiced is the price in effect on the website at the moment your order is placed and confirmed.

3.3. If your order is shipped outside the Netherlands, you are considered the importer of the purchased work.

3.4. For shipments sent outside the European Union, local customs duties, import taxes or other charges may be levied. These costs are not borne by Golden Ratio B.V. and must be settled directly by you with the competent authorities in your country.

3.5. The artwork remains the full and exclusive property of Golden Ratio B.V. until the purchase price has been paid in full.

4. Ordering and Acceptance of Transactions

4.1. By validating your order on the website, you confirm that you have read the present General Conditions of Sale and that you accept them in full.

4.2. Once your payment has been successfully processed, you will receive an order confirmation by email, which serves as acknowledgment of your purchase.

4.3. If, exceptionally, the chosen item is no longer available (for example, due to simultaneous sale in the gallery), any payment already made for that item will be refunded.

4.4. Golden Ratio B.V. reserves the right to cancel or refuse an order if there is an ongoing or unresolved dispute concerning payment of a previous order placed by the same customer.

5. Payment

5.1. All purchases must be paid in Euro (€).

5.2. The following payment methods are accepted:

Bank card: online payment at the time of ordering. Your banking data is protected by SSL (Secure Socket Layer) encryption during transmission.

PayPal.

Gift card issued by Golden Ratio B.V.

5.3. The order will only be processed after confirmation of successful payment.

6. Delivery

6.1. Delivery and Shipping

If the purchase is collected at a location other than the gallery:

6.1.1. Orders are normally dispatched within 10 working days from the date of order. When several works are purchased in a single order, they will, as far as possible, be shipped together in one parcel.

6.1.2. Indicative delivery times from dispatch are:

Netherlands: approximately 5–10 working days

Other countries: approximately 10–15 working days (delivery times may vary depending on the destination and carrier)

6.1.3. Delivery is made to the address specified on the order form. Please ensure the information provided is complete and accurate.

6.2. Transfer of Risk

Consumer Orders (B2C):
The risk of loss or damage remains with Golden Ratio B.V. until you, or a third party designated by you (other than the carrier), physically receive the artwork. If you notice damage or any irregularity upon delivery, you must:

record your reservations in writing on the carrier’s delivery note, and

inform Golden Ratio B.V. by email within 72 hours, providing a description of the issue, photographs of the damage and a copy of the delivery note.

Business Orders (B2B):
For professional buyers, the risk of loss or damage passes to the buyer as soon as the artwork is handed over to the carrier. In case of damage or irregularity on arrival, it is your responsibility to:

note the problem on the carrier’s delivery receipt, and

notify Golden Ratio B.V. by email within 72 hours, with a description of the problem, relevant photographs and a copy of the delivery note.

In all cases, prompt notification enables us to assist you efficiently with the carrier and any claim process.

7. Right of Withdrawal, Returns and Refunds

7.1. If you are a customer residing within the European Union and have made an online purchase, you benefit from a 14-day withdrawal period starting from the date you receive your order.

7.2. Within this period, you may return the product in its original packing and condition. Once the artwork has been received and inspected, the purchase price will be refunded.

7.3. Returns must be sent to the postal address indicated on your invoice, unless otherwise specified.

7.4. Refunds are processed within 15 days following receipt of the returned artwork.

8. Consumer Guarantee

8.1. If a painting reveals a hidden defect, you should notify Golden Ratio B.V. within 10 days of delivery.

8.2. We will then work with you to identify an appropriate solution, which may include restoration or other corrective action. If no suitable solution can be found, Golden Ratio B.V. will issue a full refund.

8.3. As far as possible, the artwork should be returned in its original packaging or in equivalent protective packaging to avoid further damage in transit.

9. Copyright and Intellectual Property

9.1. The artist remains the copyright holder of their work.

9.2. The rights to reproduce and represent the artworks featured on www.golden-ratio.nl are held by the artists and by Golden Ratio B.V. in the Netherlands and SIA Art Platz in Latvia, as applicable. Any reproduction, use or adaptation of these images requires prior authorization.

9.3. All text, images, logos and other content on the website are protected by copyright, trademark and other intellectual property laws. No copying, modification or reuse of this content is permitted without the prior consent of Golden Ratio B.V.

10. Data Protection and Privacy

10.1. Certain personal data is required to process your order. This information is handled in accordance with the General Data Protection Regulation (GDPR).

10.2. By confirming your order, you agree to the processing of your personal data for purposes such as order handling, invoicing, delivery and customer support.

10.3. You have the right to access, correct or delete your personal data. To exercise these rights, you can contact us via the email address indicated on our website.

10.4. Further information regarding the collection and use of your data is provided in our Privacy Policy, which forms an integral part of these Terms of Service.

11. Applicable Law and Dispute Resolution

11.1. These terms and any contractual relationship arising from purchases made on golden-ratio.nl are governed by Dutch law.

11.2. In the event of a disagreement, both parties will first seek to resolve the issue amicably, for example through direct contact or mediation, before taking any legal action.

11.3. Golden Ratio B.V. reserves the right to amend these Terms of Service from time to time. The applicable version is the one in force on the date of your order. Updated terms will be made available on the website, and we invite you to consult them regularly.
